The USCIS has not taken any official position on whether they would allow the after I-140 3-year extension to be transferred to another employer.
Using this loophole looks like many of us have actually sucessfully tranferred the H1B to a new employer after the 6 year limit..
As long as USCIS does not release any regulations...We can do this ....
If asked officialy some attorneys say that it cannot be done and some are fine with that...
Immigration laws are kind of applied sporadically and can be pushed to a certain extent

How is this possible, EB3 ROW also has a limit to how many they can use correct? They only can use what ever is beyond the 7 % used for India/China/Mexico/Phil (28% in total). Out of 1/3 of the 140K.

I think EB3 - ROW will stop or retro. next month or for sure in the next couple of months back to where they were. Lot of people here are saying that ROW will be current soon I am not sure where they are getting these facts.
Randy and others, do go through the older threads, there are quite detailed explanation of quota allocations. ROW is the rest of the world, and yes they get to use ALL of the rest: within ROW spillover occurs from EB-1 to EB-2 to EB-3, so whatever visas are available/leftover will be used up by EB-3 ROW -- they have suffered massive retrogression for many years, and now early PDs will not be stuck in the FBI blackhole.
I am not saying that EB-3 ROW cutoff will necessarily move further forward (i.e forward from Jan05) -- DOS intent is to use up all the remaining greencards -- and it might well be that the current cutoff will achieve that goal -- if it doesn't only then will they move the EB-3 ROW dates forward. Oversubscribed countries get a spillover ONLY if EB-1 ROW + EB-2 ROW + EB-3 ROW still leave unused visas.

IV have given enough information to everyone. IV have proved that they can do it if they get our support.
What else do we want, when we have people willing and taking efforts to go to DC sacrificing their personel time, family and spending their own money. Time has come for everyone to come forward and contribute money. They along with QGA are meeting the senators.
For those who have contributed more than once, thanks a lot to you guys. For those who have not contributed so far, please come forward and please contribute money. Contributing money to IV is not going to make you rich or poor. By contributing money to IV you are doing a favor to yourself.

My 485 status online just changed today. Here's the new message:
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case is now pending at the office to which it was transferred.
The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office. The previous message said that "my case was transfered from CA to NSC on Sept 12th 2007". I had been seeing the previous message for the past 9 months. Anyone knows what the new message means?
Coincidentally, I had called today and spoke with an IO to check on the status of my 485. He said that within 30-60 days it should get assigned to an officer. Would this have any bearing on the new status message? I see an LUD with today's date.

I am in the same boat. In my online status it showed exactly same msg. Then after couple of days it started showing the following msg:

On May 19, 2008, we transferred this case to our DES MOINES, IA location for additional processing. You will be notified by mail when a decision is made, or if the office needs something from you. This case has been sent to our DES MOINES, IA location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Since I140 petition is for future employment, it shouldn't matter that you were on F1 when it was filed. However, you may have a problem with adjustment of status. You may have to do consular processing if you are still on F1. But since you've changed to H1, I don't think it matters again. Could you consult an attorney or pose this question at the next attorney conference call?
I am sorry to ask the question again, but what is the consular process? and how is it processed?

Great topic. wating one more year would mean 12 more months of rent. so even if the house depreciates it would break even considering the lost rent. This is just my opinion assuming that the depreciation would be less than 5-10% till next summer. Experts please list out the hidden costs involved in mortgage for new home buyers to be careful about.

Question: Why Canada is not in the list of countries?
US Canada has different agreement and for that 40 credits are not required. Even if a Canadian Citizen has earned 1 credit it is transferred to Canada.
US has several type of agreement between different countries. With India, it is 40 Credit. With some of the countries, no benefit.
With Canadian Citizen's benefit is reduced by windfall limit. If Canadian citizen works 15 years in USA (60 Credit) and 25 years in Canada, total retirement benefits becomes too much. So it it reduced.
If there is such new agreement between US-India, the returning Indian Citizen may have reduced benefits if they work 10 or over 10 years in USA. For example if policy says max Rs.50,000 per month. Right now for a couple it could be equivelent to over Rs.100,000.
So although for returning Indians, this news is welcome news for Indians earning credit less that 40, it may not be so for Indians earning more than 40 credits.
(I used word - couple. USA pays retirement benefit to non working spouse also - equivalent to 50% of working spouse. As I remember, India does not pay retirement benefits to non working spouse).
(The social security benefits has several components - retirement, death, disability, unemployment, medicare, ... Medicare for sure is not available for Indian Citizen returning to India)

No matter the amount of scrutiny or verification you do on your part, if your luck is not good, there may be rejection. But they will not reject, they will issue NOID. You have time to appeal etc etc.

The problem is that the Speaker and the house leader has some agreement that the only bill that goes to the floor must have the majority of the republicans votes. That is the reality. I am positive that if nothing happen this year, it will happen next year if the house will go under the Dems.
The reality is that a little group of republicans (not even conservator, Mc Cain and Flakle are conservator and you see their opinion) are agianst any type of immigration.

Congressman Udall spoke at length how the conference committee is formed, how it operates and how decisions are reached.
One thing he said is particularly noteworthy. He said, he reads his fellow congressmen and the mood of the House, and at this moment there are 300 congressmen (out of a total of 525) willing to vote in favor of the senate version of the comprehensive immigration bill as it is.
As I said in my posts elsewhere in IV, let's keep our eyes and ears open for the opnions of representatives and follow up on that.
The reality is that a little group of republicans (not even conservator, Mc Cain and Flakle are conservator and you see their opinion) are agianst any type of immigration.

The pdf file in your post indicates that you would qualify for in-state tuition if you have filed for GC. How does the university determine that you have filed for GC? After you have filed for labor or filed for 140 or only after filing of 485? Those 3 dates could be years apart and depending on how the university defines that you have filed for GC could determine the residency status. If you have any further information, please share.
They only accept filing of I-485. I submitted an appeal after I file I-485 before my son's status fo in-state tuition was approved.

Immigration and education should be two seperate things. NO support to categorize further on immigration, We should take out the country cap. It should be First come first serve basis. with necessary background checks on education and skills.

Come on folks, the reason we are suffering today is this mentality of whipping, punishing ourselves. I guess when it comes to GC processing, NOTHING is really "wrong" is it? If you get a chance to work around and beat the long lines, I guess "It's all good". Some people are lucky that they get a chance to get Labor Sub, some ppl marry the GC and some ppl like the rest of us wait in line like "honest citizens".
The REAL question is, just how many of us would have refused a good labour sub, given the present conditions, solely on the basis that "it is unfair to others"? I know i would have taken it. Reason? It's LEGAL (or used to be). Our "misfortune" (if i can use that word), is that we did not get a similar chance.
For those wondering, what I am babbling about: "Let's not look down on this guy who got his GC approved by Labour Sub, or even continuously point out that he did."
Well said, No one here is going to let go an opporturnity here, if one gets one. In my case, I did NOT go in search of one, and I did not get one. So waiting in line for years. that said, If I had got an option, I would have taken advantage of it. This guy does deserves his GC. Anyway, he/she has been here since 1997 and it is a long time too.
